NBC: Old Law May Stall Trump Bid to Undo Obama Regulations

US courts are providing checks, balances and brakes on the Trump administration’s agenda to reverse policies of previous presidents. “In recent weeks, federal judges have blocked the administration's attempts to end the Deferred Action for Childhood Arrivals program (DACA), postpone a rule giving low-income families broader access to housing in wealthier neighborhoods, and delay an environmental regulation requiring oil and gas companies to reduce methane leaks,” reports Suzy Khimm for NBC News. The courts are relying on the 1946 Administrative Procedure Act that requires federal agencies to provide reasoned justifications and allow public comment when they are substantially changing existing rules. The law’s purpose, Khimm explains, is “to limit executive authority and make the policymaking process deliberative, rational and democratic.” A polarized democracy does not benefit from major back-and-forth policy swings or, as the law, notes “arbitrary and capricious” rule-making.
